What is Civil Law?
Civil law refers to the branch of law regarding the relationships and contract exchanges between private parties (individuals, businesses or organizations). It is usually a private lawsuit between two or more parties for infringing upon an individual's rights and protections. Typically, the objective in a civil lawsuit is the attempt to honor an agreement, right a wrong, or settle a dispute.
Civil Law is divided into two branches: Tort Law and Contract Law. Tort Law is a legal term for any civil or criminal wrongdoing that is recognized by law as grounds for a lawsuit. Contract lawsuits are usually filed for breach of contract, in which one of the parties fails to live up to their responsibilities under the contract without a legally valid excuse.
The different types of civil law vary greatly. Some examples of civil law offenses include:
- Family Law
- Real Estate Law
- Contracts (breach of contract, etc.)
- Warranties
- Theft and Property Laws
- Trespassing
- Privacy Laws
- Landlord / Tenant Law
- Medical Malpractice
- Wrongful Death
- Personal Injury
- Business Litigation
- Defamation (libel and slander)
What is the difference between a Civil Case and a Criminal Case?
At its most basic, civil law encompasses any type of law that is not criminal law. Civil lawsuits are initiated by the victim, rather than the federal or state government through a prosecutor. Unlike criminal cases where the defendant must be found guilty beyond a reasonable doubt in order to be convicted, in a civil case, if it is "likely" the defendant is liable then the victim will receive restitution. Defendants found liable in civil court do not receive prison sentences or capital punishment, but rather are subject to pay damages and financial compensation to the victim.
